Insights of Injury Law And Role of Injury Lawyer
Laws are made for the betterment of the society. There are several types of laws and lawyers which include all the categories which affects a mans life irrespective of his class, status, background, profession etc. Constitution, environment, business, healthcare, accident and many more, all of them have several laws rules which are to be followed. Hence there are hardly any field which don’t a have set of laws formed for it. In short we are surrounded by laws. There are certain sectors whose laws adversely affect our day to day life like health, civil, crime, estate, business, family etc. hence many lawyers specialize in those sectors. Injury law is one of those laws.

Injury law:
An injury can happen at any point of time at any place similarly the cause for the injury also varies. In many cases we have the rights to claim the compensation for our injury depending on the party to whom you are asking to compensate. It can be a person or a company or an agency or any other entity. The injury not need to be physical it can be a psychological as well. A person is eligible to claim when the injury is the result of any sort of wrong doing of anyone. Tort law acts against those people because of whom an individual suffers or gets harmed in any manner. The harm can result in the commitment of any torturous act by the victim. Tort law acts against the civil wrongs or damage related to economy, property or violation of rights unlike the injury law. Though personal injury lawyers are also trained to handle such cases perhaps the set of rules under personal injury law differs from tort law but still many times personal injury law is considered under tort law. Injury law primarily works on injury caused by medical negligence. It acts against the medical representative whose act has lead to injury. A personal injury lawyer needs to follow certain codes of conduct as any other lawyers. Their primary function is to examine the entire case of the client, draft legal documents, argue cases in the court and offer legal advice to the victim of the personal injury. It’s mandatory for such lawyers to constantly update their knowledge regarding social, scientific, technical and legal aspects. Hence very few lawyers belonging to other sectors accept cases from this section.

A personal injury lawyer need to clear a written examination conducted by bar council. Their specialized knowledge and experience limits the variety of cases they get but their specialization increases the chances of client satisfaction since they get their confidence level roused during the argument in the court. The lawyers charges or fees are based on many factors like difficulty of the case or cost spent on the case or many times the outcome of the client if he wins the case etc. Many lawyers work as a solo practicing lawyer and many times a group of lawyers come up with an agency or a law firm.

Thus personal injury lawyer is a person who is the legal representative of the victim suffering from injury caused due to medical negligence or incorrect action by an entity.

Why Being a Lawyer Is Difficult

Why Being a Lawyer Is Difficult

All professions come with their highs and lows which could either do a world of good or suck out the lifeblood from the ones in the profession. Problems persist with almost all fields and it takes more than courage and perseverance to come out clean. Law, which is one of the oldest professions, is no exception to these problems. Being a lawyer may sound like a lucrative career with many benefits that include a promising future, non- monotonous work, dealing with a variety of people, helping the poor, uncovering the veil from justice since lawyers are the defenders of law and justice.

Let’s explore a few reasons why choosing to be a lawyer can prove to be a decisive point in your life.

Start From Scratch:
Unlike most sedentary jobs that have interview or a set of interviews as an important part in the hiring process, lawyers are reprieved from such interviews unless of course they haven’t decided to join any corporate firms or government that has a stringent hiring process.
As a newbie, lawyers are to work as juniors under some experienced lawyers in order to gain a considerable experience after which they would be able to start their own venture. But this transition isn’t a smooth one, it’s afflicted with many hills and troughs which have made many lawyers to give up prematurely. But like all other jobs, it’s the start that is always troublesome; once past this, the rest of the ride should be a smoother one.

Establishing Your Name:
As said above, lawyers are to work as juniors to kick-start their career. This period in fact is a dormant stage where they are at the mercy of their seniors. Unfortunate ones may end up under the guidance of unpleasant seniors who might take the advantage by assigning unrelated works, using juniors as a cover-up for their malicious activities under the pretext of letting them gain experience. Many succumb to these unjust acts, very few prevail. It’s only after a few years; these junior lawyers get their recognition since their seniors take away all the plaudits of their works.

No Regular Income:
It’s a popular belief that lawyers are paid well which in fact is true to a large extent, but the number of lawyers who do not have a steady income is noticeable too. Since it takes a considerable time to carve out a niche in this field, these lawyers are then forced to work at an abysmally lower rate as compared to others in the field. They end up getting clients who are poor and needy and hence give up expecting more money from them. These lawyers go without earning money for months and hence give up, largely against their wishes.

Risks involved in this field are enormous. Lawyers are ought to go into depths in cases they take. This involves meeting up with clients and the opposition, meeting eye-witnesses, going to hostile places and interacting with unwelcoming people so as to get that extra edge during the court hearing or final conviction. Taking care of such nuances go a long way in the final verdict. Criminal lawyers may have to meet the convicted person; the meeting if not handled diplomatically can lead to appalling consequences, few of which might conclude in death. The prosecutors who are against the indigenous or religious sects continuously face threats from their leaders. Many of the threats flake out but there have been instances when such ordeals have culminated into disastrous consequences.

Despite above hindrances, this profession has many aspects to offer. Every other day you come to know different things. The clients are new and the cases different from each other. These factors force lawyers to work on different cases at a given time. This multi-tasking makes them a quick thinker and interpreter and helps in analysing all possible outcomes effortlessly. Thus, this profession has its share of highs and lows. It thoroughly depends on a person’s mindset and his approach to pick up this as his profession.

7 Characteristics Of A Good Lawyer

7 Characterstics of a Good Lawyer

Lawyers are ones who we think of when we are in a pickle. They are the legal advocates of law who are approved by the Bar Council to deliver justice. But mere passing the Law degree and getting the license from the Bar Council do not ensure a successful career in this field. Lawyers are to blend the professional prowess with their personal attributes to fly high.

Here are a few qualities that if lawyers possess, can work wonders for them.

Power of Listening:
It’s so obvious that in a profession that demands dealing with different people, the power of listening plays a very crucial part. It’s impossible for a person without the listening capacity to even contemplate having a successful career. Listening to your clients or listening to court orders and verdicts is very important since missing out on a few notes by either of them can lead to quite a lot of problems in the long run.

Communication skills:
If there is anything that comes close to the power of listening in terms of importance and a mandatory attribute, it’s the communication skills. This is not a profession for shy and introvert people who keep things to themselves. They should know how to describe a scenario to their clients and present the case courteously and tactfully in the court room. It becomes quite handy to know the local language while dealing with local clients.

Law is a profession that can be very stressful. Treachery, threats, extortion aren’t something unheard of. It is so important to keep the cool even during tough times since in this profession subjugation finds no place. It is the firmness of character that will eventually sail you through.

Good Rapport With Fellow Lawyers:
Here, in this field, you get clients mostly through your acquaintances. The more you increase your contacts, the better chances of getting more clients and thus more work. Who else would suit perfect for the acquaintances than your fellow lawyers! The equation is simple: the more amicable you are to them, the more obliged they would be when you need help.

Fear has no place in this profession. Threats can arise from anywhere and from the unlikeliest of sources. They can come from your own clients, the opposing party, fellow lawyers; absolutely anyone. And if you are relatively new to this field then you become an easy prey. The only way out is to stay undeterred and not to give up easily.

Work Experience:
It’s absolutely true that experience teaches you what your curriculum doesn’t. Hence lawyers start their career by working under the supervision and guidance of some senior lawyers so as to gain some experience, doing so, they learn things their curriculum didn’t teach them. It’s natural for clients to prefer lawyers with experience over the ones without experience. Moreover, experience raises the standard which helps in staying above other lawyers.

Lawyers have to be infallible, both in thinking and interacting. They should possess high analytical thinking power to analyse and deduce things at the earliest. And also while dealing, there could be scenarios where the integrity and character of lawyers would be put to test. If lawyers were to support a weaker client then the stronger one would try to lure them with lucrative offers so as to leave the case or to turn the back against their own client. The clients trust their lawyers and more than money it’s the name that will take them a long way.
